Horacio focuses his practice on the legal and regulatory aspects of energy and infrastructure projects. He has participated in natural gas pipelines, LNG terminals, conventional power plants, wind energy, photovoltaic and toll road projects. As well, he has advised both lenders and borrowers in project finance facilities.

Horacio is considered one of the four leading lawyers in Energy and Natural Resources practice area in Mexico by Chambers & Partners, and one of the top three leading lawyers in Projects practice area in México by Chambers & Partners. Amendment to several provisions of the LGSM by which the use of electronic, optical or any other technological means for the holding of meetings or sessions is regulated

CRE modifies regulation regarding cogeneration of electric energy

On May 26, 2023, the Energy Regulatory Commission ("CRE") published in the Official Gazette of the Federation the "Resolution of the Energy Regulatory Commission by which the reference values of the methodologies for the calculation of the efficiency of electric energy cogeneration systems and the criteria to determine the Efficient Cogeneration are updated, as well as the efficiency criteria and calculation methodology to determine the percentage of fuel-free energy established in Resolutions RES/003/2011, RES/206/2014, RES/291/2012 and RES/1838/2016, respectively" (the "New Resolution").

Client Alert | Resumption of appeals amparos relating to amendment of Electricity Industry Law

On October 17, 2022, General Agreement number 7/2022 was published in the Official Gazette of the Federation, whereby Mexico’s Supreme Court of Justice removed the stay on the resolution of the appeals under review by the Administrative Circuit Courts, where the constitutionality of the Decree amending the Electricity Industry Law is being analyzed (the "LIE Amendment").  Such stay had been ordered by General Plenary Agreement 3/2022 of the Supreme Court, which determined that the corresponding resolutions would not be issued until the action of unconstitutionality filed by several Senators and the constitutional controversies filed by the Federal Commission of Economic Competition and the State of Colima against said amendment were resolved.

CRE fines Iberdrola for the sale of electricity in a purported breach of the Law

On May 25, 2022, the Energy Regulatory Commission (the “Commission”) published resolution number RES/4662022 (the “Resolution”), whereby it imposed an administrative fine of more than MXN$9 billion to Iberdrola’s subsidiary Iberdrola Energía Monterrey, S.A. de C.V. (“IEM”). This, in connection with a combined cycle power plant with an installed capacity of up to 619.3 MW, which operates under the self-supply power generation permit number E/205/AUT/2002 that was granted by the Commission to IEM in 2002, in terms of the now-repealed Law of the Public Service of Electric Energy (“LPSEE”).

Supreme Court postpones ruling on amparos against the amendment to the Electricity Industry Law.

On February 22, 2022, Mexico’s Supreme Court issued the General Resolution number 3/2022, ordering the postponement of the rulings to be issued by the Federal Circuit Courts on the appeals filed against the rulings issued by the Federal District Courts in the amparo proceedings regarding the constitutionality of the Amendment to the Electricity Industry Law published on March 9, 2021 (the “Appeals”).

District Court grants definitive injunction of the New Grid Code for the National Electricity Grid.

On February 25, 2022, the Second District Court in Administrative Matters Specialized in Antitrust, Broadcasting and Telecommunications (the "Court") granted a definitive injunction with general effects against the application of the new Grid Code (published on December 31, 2021 by the Energy Regulatory Commission through resolution number RES/550/2021 whereby the “General Administrative Provisions containing the criteria for efficiency, quality, reliability, continuity, safety and sustainability of the national electricity system: the Grid Code” were issued), in an amparo proceeding filed by several companies in the electricity sector.

The Resolution that establishes the merchandise which import, and export is subject to regulation by the Ministry of Energy, published on December 26, 2020, resumes its validity and effects.

On December 26, 2020, the Ministry of Energy ("SENER") published in the Federal Official Gazette the "Resolution that establishes the merchandise which import, and export is subject to regulation by SENER" (the “SENER Resolution”), which was suspended as a result of several court injunctions with erga omnes effects (i.e., for the benefit of everyone, not only the parties who had brought the court proceedings). In this regard, on March 3, 2021, the Ministries of Energy and Economy, in compliance with these injunctions, published the "Resolution that suspends all consequences and effects derived from the Resolution that establishes the merchandise which import, and export is subject to regulation by the Ministry of Energy" (the "Suspension Resolution").

Ministry of Energy issues Guideline urging the CRE to set methodology for maximum LP gas prices

On July 28, 2021, the “Emergency Guideline for the Welfare of the LP Gas Consumer” (the “Guideline”) was published in the Mexican Official Gazette (“DOF”), as per its initials in Spanish), by which the Ministry of Energy urges the Energy Regulatory Commission (“CRE”), as per its initials in Spanish) to establish a methodology to set maximum prices for the final consumer of LP gas within a maximum period of three days, which would be in effect for six months from the date of its publication in the DOF.

Energy Regulatory Commission modifies regulation on permit updates

On June 25, 2021, the Energy Regulatory Commission (“CRE”) published in the Official Gazette of the Federation the resolution number A/019/2021 (the “Resolution”) whereby the regulations relating to permit updates were amended – permit “updates” consist of changes relating to the permit holder or the project that are of a corporate or administrative nature, or that are of a technical nature but without affecting the activity subject matter of the permit in a substantive manner, whereas for substantive modifications, permit holders would have to request an “amendment” of their permits, a process that is more onerous from an administrative standpoint.
