Carlos Orcí is recognized leader in Latin America competition/antitrust law because of his expertise and strong bonds with the various antitrust authorities, judges, lawyers, and economists, as well experts in regulated sectors in the region.

Among his exclusive tools, Mr. Orcí has developed a high-end technology system to address companies’ competition/antitrust needs.  

Carlos has advised companies in Mexico in landmark competition/antitrust matters on behalf of national and international clients regarding merger control procedures; as well as in defending companies facing investigations on monopolistic practices.  He has also advised clients during investigations related to essential facilities and barriers to entry conducted by the Federal Economic Competition Commission (Cofece) and the Federal Telecommunications Institute (Ifetel) and challenged governmental resolutions against the federal courts. 

He also has extensive experience on auctions, obtaining concessions, and conducting administrative procedures before the Communications and Transport Ministry, Ifetel and the Foreign Investments Commission, among many other matters. 

Mr. Orcí’s experience spans a wide range of industries, including technology, media and telecommunications, banking/financial services, aviation, chemicals, pharmaceuticals, mining, maritime, railways, transport, consumer products, and automotive sectors.

Carlos has a unique prestige for founding and leading MootComp, an international organization which serves as an open forum for the debate of the main topics on antitrust/competition law and policy. Through practical cases and interdisciplinary work, MootComp promotes education in competition//antitrust law and generates labor opportunities for to its participants, while servicing as exceptional networking platform between the main proponents and practitioners of this area of law at the international level.

COFECE issues Emergency Regulatory Provisions for the processing and ruling of complaints regarding the Advertising Law

On August 31, 2021, in view of the enactment of the Law for Transparency, Prevention, and Combat of Unfair Practices in Advertising Contracts (the “Advertising Law”), the Plenum of the Federal Economic Competition Commission (“COFECE”) issued Emergency Regulatory Provisions to provide legal certainty to the process of complaints that may be filed for the possible violations to the Advertising Law.

Ministry of Energy issues Guideline urging the CRE to set methodology for maximum LP gas prices

On July 28, 2021, the “Emergency Guideline for the Welfare of the LP Gas Consumer” (the “Guideline”) was published in the Mexican Official Gazette (“DOF”), as per its initials in Spanish), by which the Ministry of Energy urges the Energy Regulatory Commission (“CRE”), as per its initials in Spanish) to establish a methodology to set maximum prices for the final consumer of LP gas within a maximum period of three days, which would be in effect for six months from the date of its publication in the DOF.

COFECE issues opinion on the competition implication of the Resolution of measures for COVID-19 issued by CENACE
