Energy Regulatory Commission extends suspension of the terms and deadlines

As a consequence of the measures ordered by Mexico’s General Health Council and Ministry of Health to prevent and combat the spread of the Coronavirus Covid-19, on April 8, 2020.

The Energy Regulatory Commission (“CRE”) published the resolution number A/014/2020 (the “Resolution”) in the Federal Official Gazette, amending the Resolution number A/010/2020 that was published on March 24, 2020. The Resolution provides that the suspension of the terms and deadlines of the acts and procedures carried out before CRE, is to be extended to April 30, 2020. Additionally, the Resolution extends the suspension previously provided for the start of term of all requests and applications submitted to CRE during the suspension term, which shall now be deemed as filed on May 4, 2020. Considering that May 1st through 3rd are deemed as public holidays in Mexico, the foregoing implies that: (i) the terms and deadlines of the proceedings handled by CRE will be suspended until May 3, 2020 and will resume on May 4, 2020; (ii) the compliance of periodic obligations before CRE will be suspended until May 3, 2020, and will resume on May 4, 2020; and (iii) the requests and applications submitted to CRE during the suspension period will be deemed as filed on May 3, 2020 (and consequently, the term for their resolution will commence as of such date).
