Suspension of the terms and deadlines of the Energy Regulatory Commission

On March 24, 2020, the Energy Regulatory Commission (“CRE”) published the resolution number A/010/2020 (the “CRE Resolution”) in the Federal Official Gazette. By means of the CRE Resolution, CRE ordered the suspension of the terms and deadlines of the acts and procedures carried out before CRE, as of the date of the publication of the CRE Resolution and until April 17, 2020, as a measure to prevent and combat the spread of the Coronavirus Covid-19.

Additionally, the CRE Resolution sets forth that all requests and applications submitted to CRE within the term of the suspension will be deemed as filed on April 20, 2020. The foregoing implies that: (i) the terms and deadlines of the proceedings handled by CRE will be suspended until April 17, 2020 and resumed on April 20, 2020; (ii) the compliance of periodic obligations before CRE will be suspended until April 17, 2020, and resumed on April 20, 2020; and (iii) the requests and applications submitted to CRE during the period of suspension will be deemed as filed on April 20, 2020 (and consequently, the term for their resolution will commence as of such date).

Suspension of the Terms and Deadlines of the Ministry of Energy On March 25, 2019, the Ministry of Energy (“SENER”) published in the Federal Official Gazette the Resolution establishing the suspension of the terms and deadlines of SENER, as a measure to prevent and combat the spread of the Coronavirus Covid-19 (the “SENER Resolution”). By means of the SENER Resolution, SENER establishes that all days during the period from March 25, 2020 to April 19, 2020 will be deemed as non-business days for all legal effects. All the requests and applications submitted to any of SENER’s administrative units during such timeframe will be deemed as filed on April 20, 2020. However, urgent procedures of acquisitions, leases and services of extreme urgency are exempted from the suspension period ordered by SENER.
