Amendments in the implementation of SARS-CoV2 tests to employees in Mexico City

On July 28, 2020, Mexico City’s authorities issued certain amendments to the Guidelines for the execution of the gradual plan towards the new normality for Mexico City (the "Guidelines") in connection with the obligation of employer entities.

On July 28, 2020, Mexico City’s authorities issued certain amendments to the Guidelines for the execution of the gradual plan towards the new normality for Mexico City (the "Guidelines") in connection with the obligation of employer entities to practice SARS-CoV2 medical detection tests on their employees rendering services at the workplace. The aforementioned amendments resulted as follows: • The number of employees who must be physically rendering their services at the workplace so that it is mandatory to perform tests for the SARS-CoV2 virus increased from 30 to 100. • The total workforce to which the SARS-CoV2 virus screening tests must be performed was reduced from 5% to 3%. It is important to highlight that employers must carry out detection tests on a weekly basis at their own expense. Based on the above, it is important to consider that the Guidelines provide that owners or responsible entities of the operating workplace will have the obligation to report to the Public Telephone Location Service (Locatel) (55 56 58 11 11), the date on which the test was performed and its result. A reference number will be assigned to the report for follow-up purposes. Likewise, employers must ensure that each of the employees in the group that underwent medical tests conduct a COVID-19 self-diagnosis through either of the following alternatives: (i) sending a free of charge text (SMS) with the word “covid19” addressed to number 51515; (ii) responding to an online test on the website https://test.covid19.cdmx.gob.mx/; (iii) responding to a telephone interview with Locatel’s officials (5658-1111), or (iv) sending a direct message to the official account of the Mexico City Government on Facebook https://www.facebook.com/GobiernoCDMX/ with the words “covid19”. If the group test was positive for COVID-19, the entire group should remain quarantined at home and an individual test must be carried out to each employee.
