Aisha Calderón

Associate since 2014


Aisha joined our Firm in 2010 starting as a law student, and has been an associate since 2014. She works in the Energy practice area, with a focus on renewable energies and environmental matters.

She has participated in multiple energy projects, from their development and construction to their financing and operation, and has extensive experience in matters related to governmental authorizations, construction, supply and operation contracts, and power purchase agreements.

She has in-depth experience in all aspects of renewable energy projects, advising firms in their day-to-day operations and in their participation in the Electricity Market, as well as in the framework of M&A, securities and financing transactions.

Aisha has a Law Degree from the Universidad Panamericana, with a specialization in Administrative Law from the same University. She holds an MSc in Environmental Protection and Management from the University of Edinburgh, where she graduated with merit. Her master’s thesis, an analysis of environmental and agricultural public policy in Mexico, obtained the “Henry Gilbert Miller prize for best agricultural dissertation” from the Scotland Rural College of at the University of Edinburgh and the “MSc in Environmental Protection and Management Best Dissertation prize” from the School of Geosciences.

Additionally, Aisha is the current Coordinator of the Pro Bono Practice of the Firm and is part of the D&I committee, where various activities have been carried out around these two trending topics in the legal market.

CRE issues regulations in matters of assets’ transfer for connection and interconnection

On January 26, 2024, the Energy Regulatory Commission ("CRE") published the Resolution number A/065/2023 issuing the "General administrative provisions regarding contributions, the methodology for calculating contributions, the criteria and basis for determining and updating the amount for contributions and the corresponding template agreements" (the "Regulations").

Resolutions that modified the Guidelines regarding Clean Energy Certificates are declared null and void

On March 12, 2024, the Ministry of Energy published in the Federal Official Gazette the Resolution informing all participants of the wholesale electricity market and the population in general, that the "Resolution amending the Guidelines that establish the criteria for the granting of Clean Energy Certificates and the requirements for their acquisition published on October 31, 2014" and the "Resolution amending the Second Transitory Article of the Resolution amending the Guidelines that establish the criteria for the granting of Clean Energy Certificates and the requirements for their acquisition published on October 31, 2014", published on October 28 and December 10, 2019, respectively, have become null and void.

Energy Regulatory Commission modifies requirements related to the modification and transfer of permits

On January 17, 2024, the Energy Regulatory Commission ("CRE") published the resolution number A/062/2023 (the "Resolution") which modifies resolution number RES/390/2017 that provides the General regulations that set forth the terms and conditions to request the authorization for the amendment or transfer of energy generation and supply permits (the “Regulations”).

New regulations relating to cross-participation in the Hydrocarbon Sector are published

On February 27, 2024, the Energy Regulatory Commission (“CRE”) published in the Federal Official Gazette, the resolution number A/047/2022 whereby the General Administrative Provisions that establish the procedure and requirements for the authorization of cross participation, the methodology for the analysis of its effects on competition, market efficiency and effective open access and, interpret for administrative purposes, the cross participation foreseen in the second and third paragraphs of article 83 of the Hydrocarbons Law (the “New Regulations”) were issued, and which repeal the provisions previously in force and that were published in the Official Gazette of the Federation on March 3, 2016 under resolution number A/005/2016 (the "Previous Regulations").

The Federal Economic Competition Commission subjects the purchase of Iberdrola's generation plants to the fulfillment of commitments

On February 15, 2024, the Federal Economic Competition Commission (“COFECE”) informed through a press release that it conditioned the closing of the transaction consisting of the acquisition by Mexico Infrastructure Partners FF, S.A.P.I. de C.V. (“MIP”) and Fondo Nacional de Infraestructura (“FONADIN”) of certain powers plants owned by Iberdrola Generación México, S.A. de C.V. and its subsidiaries (“Iberdrola”) (the “Transaction”), to certain commitments to allow the closing.

CRE issues new regulations regarding the acquisition of private grids by CFE

On January 18, 2024, the Energy Regulatory Commission (“CRE”) published resolution number A/051/2023, in the Official Gazette of the Federation, which sets forth the "General Criteria for the Evaluation of the Net Benefit of works requested by private parties to be included in the Expansion and Modernization Programs of the National Transmission Grid and the elements of the General Distribution Grids corresponding to the Wholesale Electricity Market, as well as for the transfer and acquisition of private grids, based on articles 34 and 44 of the Electric Industry Law" (the “Regulations”).

CRE modifies regulation regarding cogeneration of electric energy

On May 26, 2023, the Energy Regulatory Commission ("CRE") published in the Official Gazette of the Federation the "Resolution of the Energy Regulatory Commission by which the reference values of the methodologies for the calculation of the efficiency of electric energy cogeneration systems and the criteria to determine the Efficient Cogeneration are updated, as well as the efficiency criteria and calculation methodology to determine the percentage of fuel-free energy established in Resolutions RES/003/2011, RES/206/2014, RES/291/2012 and RES/1838/2016, respectively" (the "New Resolution").

Client Alert | Resumption of appeals amparos relating to amendment of Electricity Industry Law

On October 17, 2022, General Agreement number 7/2022 was published in the Official Gazette of the Federation, whereby Mexico’s Supreme Court of Justice removed the stay on the resolution of the appeals under review by the Administrative Circuit Courts, where the constitutionality of the Decree amending the Electricity Industry Law is being analyzed (the "LIE Amendment").  Such stay had been ordered by General Plenary Agreement 3/2022 of the Supreme Court, which determined that the corresponding resolutions would not be issued until the action of unconstitutionality filed by several Senators and the constitutional controversies filed by the Federal Commission of Economic Competition and the State of Colima against said amendment were resolved.

Supreme Court issues judicial precedent concerning amendment of terms and conditions of permits

On June 17, 2022, precedent number 1a./J. 83/2022 (11a.) on administrative matters was published in the Judicial Gazette of the Federation. The heading of the precedent reads: "Electric Energy. The conditions of the permits to generate it issued by the Energy Regulatory Commission (CRE) in favor of private parties, are subject to modifications due to changes in law.”

CRE fines Iberdrola for the sale of electricity in a purported breach of the Law

On May 25, 2022, the Energy Regulatory Commission (the “Commission”) published resolution number RES/4662022 (the “Resolution”), whereby it imposed an administrative fine of more than MXN$9 billion to Iberdrola’s subsidiary Iberdrola Energía Monterrey, S.A. de C.V. (“IEM”). This, in connection with a combined cycle power plant with an installed capacity of up to 619.3 MW, which operates under the self-supply power generation permit number E/205/AUT/2002 that was granted by the Commission to IEM in 2002, in terms of the now-repealed Law of the Public Service of Electric Energy (“LPSEE”).
