Rodrigo del Valle, joined the Firm in 2016 and focuses on providing advice on a wide range of labor issues. He has represented and advised Mexican and foreign companies in corporate transactions, including mergers and acquisitions, project finance and corporate reorganizations. He has actively participated in the design and implementation of compensation structures for high-level executives, preventive strategies, collective dispute resolutions and employee transfer processes, among others.

Rodrigo actively participates in providing legal advice to clients regarding possible ESG risks, as well as in identifying measures to be implemented to guarantee compliance with said criteria from an employment perspective. The foregoing in order to help companies manage their risks more effectively and be more competitive in the market.

The Ministry of Labor and Social Welfare publishes the rules for renewing the registration as an authorized specialized services provider

On February 21, 2024, amendments to the general provisions for the registration as an authorized specialized services provider referred to in Article 15 of the Mexican Federal Labor Law were published in the Official Gazette of the Federation (the “Resolution”) aimed to establish the provisions that specialized service providers (the "Specialized Providers") must follow for the renewal of the Registry of Specialized Service Providers ("REPSE", per its acronym in Spanish).

Mexican Senate approves the update of the Table of Occupational Diseases

On October 24, 2023, the Senate of the Republic unanimously approved an amendment to update the Table of Occupational Diseases (the "Amendment"). This Table had remained unaltered since the enactment of the Mexican Federal Labor Law in 1970.

Publication of the NOM-037-STPS-2023 concerning teleworking

The Federal Labor Law ("LFT") provides that telework is any employment relationship that is performed in a place other than the work center through the use of information technology and does not require the physical presence of the employee. Any workday developed beyond 40% of the time performed under this modality is considered teleworking. The same LFT, in its transitory articles, provided the Federal Executive with a term to publish the Official Mexican Norm NOM-037-STPS-2023 ("NOM", per its acronym in Spanish) to govern the obligations of this modality.

VELAVO - Publication of the Voluntary Labor Verification Program

The Ministry of Labor and Social Welfare (“STPS” per its acronym in Spanish) has designed the “Accreditation System for Good Labor Practices and Decent Work”, which aims to promote and strengthen good practices of employer companies in Mexico so that workers have decent work conditions, acquire the necessary training to carry out their activities and develop their activities in workplaces with adequate safety and hygiene conditions.

Sustainable Taxonomy of Mexico | Legal analysis and main implications.

Mexico's Sustainable Taxonomy (the "Taxonomy"), a classification tool created through a broad, participatory, and coordinated three-year process to identify and define activities with positive effects on the environment and society, following technical criteria and international standards was presented on March 16, 2023 by Gabriel Yorio, assistant secretary of the Ministry of Finance and Public Credit “Secretaría de Hacienda y Crédito Público” (“SHCP”) within the framework of the 2023 Banking Convention.

COVID-19: Labor Implications

On March 24, 2020, the Mexican Ministry of Health enacted a decree in the Federal Official Gazette by means of which preventive measures were imposed in order to mitigate and control the health risksoriginating from COVID-19 (the “Decree”), such Decree was later approved by the United Mexican States President, Andres Manuel Lopez Obrador, on that same date. The Decree will be legally binding as of March 24, 2020 until April 19, 2020.
