Creation of District Courts for Commercial Insolvency Matters

On March 4, 2022, General Agreement 4/2022 of the Federal Judiciary Council was published in the Federal Official Gazette, by means of which the First and Second District Courts in Commercial Insolvency Matters (the “Insolvency District Courts”) are created.

The Insolvency District Courts will start operating on March 7, 2022; they will be located in Mexico City and will have jurisdiction in all of the country to handle all controversies on insolvency matters referred in the Commercial Insolvency Law, as well as indirect amparo proceedings related to such matters.

Some of the commercial insolvency files which are currently handled by mixed, specialized or semi-specialized district courts in civil or commercial matters, will be handed to the new Insolvency District Courts once the corresponding lists and delivery-reception minutes are issued.
