Amendment to Hydrocarbons Law in matters of asymmetric regulation for PEMEX

On May 19, 2021, the Decree amending the Thirteenth Transitory Article of the Hydrocarbons Law (the “Amendment”) was published in the Official Gazette of the Federation, as a result of the bill presented before the House of Representatives on April 20 and passed by Congress on April 29, 2021.
For context, the original text of Transitory Article Thirteenth of the Hydrocarbons Law (“HL”) granted powers to the Energy Regulatory Commission (“CRE”) to issue regulation in matters of economic competition, specifically, asymmetric regulation, on first-hand sales and marketing carried out by Petróleos Mexicanos (“Pemex”).
